01 Acceptance of terms

These Terms & Conditions (the "Terms") govern your access to and use of compassmarketing.ai and any related pages (the "Site"), operated by Compass Marketing ("Compass," "we," "us," or "our").

By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you're using the Site on behalf of a company, you represent that you have authority to accept these Terms for that company. If you don't agree, please don't use the Site.

You must be at least 18 years old, or the age of majority where you live, to use the Site.

02 Using the Site

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your own informational and business-evaluation purposes. You agree not to:

  • Use the Site in any way that violates any applicable law or regulation.
  • Submit false, misleading, or someone else's information through our forms.
  • Send spam, malware, or any code designed to harm or interfere with the Site.
  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems.
  • Scrape, crawl, or harvest content or data from the Site using automated means, except for standard search-engine indexing.
  • Copy, reproduce, or republish our content, design, or branding without our written permission.
  • Frame or mirror the Site, or imply that we endorse you or your business.

We may suspend or restrict access to the Site at any time, for any reason, without notice.

03 Our services

The Site describes the marketing services Compass offers, including strategy, SEO, answer engine optimization (AEO), generative engine optimization (GEO), paid media, brand and creative, web design, social and content, and analytics.

Any paid engagement with Compass is governed by a separate written agreement (such as a master services agreement, statement of work, or signed proposal). If there's a conflict between that agreement and these Terms, that agreement controls.

Service descriptions on the Site are general summaries, not offers. Scope, deliverables, timelines, and pricing are set only in a signed agreement. We may change, add, or discontinue the services we describe at any time.

04 Free growth plan

When you request a free growth plan, we'll review the information you share and publicly available information about your business and offer recommendations during a consultation. The growth plan is:

  • Free and no-obligation. You're under no obligation to hire us, and you're welcome to implement the recommendations yourself.
  • General in nature. It's based on limited information and is not a guarantee of any outcome.
  • Offered at our discretion. We may decline or limit requests, for example from competitors or where we can't provide useful recommendations.

05 Results & testimonials

Case studies, statistics, and testimonials on the Site reflect the experiences of specific clients under specific circumstances, including their industry, budget, competition, market conditions, and the work they did alongside us. They are not a promise or guarantee that you will achieve the same or similar results.

Marketing performance depends on many factors outside our control, including search engine and platform algorithms, ad auction dynamics, AI model behavior, and your own products, pricing, and operations. We do not guarantee any specific ranking, placement, citation, traffic, lead volume, return on ad spend, or revenue. Any performance targets are set out only in a signed agreement.

06 Intellectual property

The Site and all of its content — including text, graphics, logos, the Compass name and compass mark, "The Compass Way," page designs, and code — are owned by Compass or our licensors and are protected by copyright, trademark, and other laws. Except for the limited license in section 02, no rights are granted to you. All rights not expressly granted are reserved.

Other names, logos, and trademarks mentioned on the Site (such as search engines, ad platforms, and AI assistants) belong to their respective owners, and their mention does not imply any affiliation or endorsement.

07 Your submissions

You keep ownership of the information you send us through the Site. You grant us permission to use it to respond to you, prepare your growth plan, and evaluate a potential engagement, as described in our Privacy Policy. You're responsible for making sure you have the right to share anything you submit.

If you send us ideas, suggestions, or feedback about the Site or our services, we may use them freely without any obligation to you.

08 Third-party links

The Site may link to third-party websites, tools, or services we don't control. We provide these links for convenience only and aren't responsible for their content, policies, or practices. Your use of third-party sites is at your own risk and subject to their terms.

09 Disclaimers

The Site and all content on it are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that its content is complete, accurate, or current.

Content on the Site is for general information only and is not legal, financial, tax, or other professional advice.

10 Limitation of liability

To the fullest extent permitted by law, Compass and its owners, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of, or inability to use, the Site — even if we've been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (US $100).

Some jurisdictions don't allow certain limitations of liability, so some of the above may not apply to you. This section does not limit liability that cannot be limited under applicable law, and it does not modify any limitation of liability in a signed services agreement.

11 Indemnification

You agree to defend, indemnify, and hold harmless Compass and its owners, employees, contractors, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any rights of a third party.

12 Governing law

These Terms are governed by the laws of the State of Kansas, United States, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in the State of Kansas, and you consent to the personal jurisdiction of those courts.

Before filing any claim, you agree to first contact us and try in good faith to resolve the dispute informally for at least 30 days.

13 General terms

  • Changes. We may update these Terms from time to time. We'll post the updated version on this page and change the "Last updated" date. Your continued use of the Site after changes take effect means you accept them.
  • Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and Compass about the Site, except where a separate signed agreement applies.
  • Severability. If any provision is found unenforceable, the rest of these Terms stays in full effect.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Survival. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive any termination of your access to the Site.
